Yasha Kids Garden (YKG Contests) Debate Participation Policy establishes clear, binding terms for applicants joining sessions, ensuring compliance with Nigerian laws including Evidence Act 2011, Cybercrimes Act 2015, and NDPA 2023.

 

Definitions

  • Applicant: Any individual, company, or institution submitting this application, acting for themselves or as parent/authorized legal guardian of a minor.

  • Company: Yasha Kids Garden (YKG Contests).

  • Session(s): All interviews, debates, talk shows, events, live streams, or recordings organized, sponsored, or hosted by the Company.

 

Core Participation Terms

 

The Applicant irrevocably agrees:

  • Sessions may be recorded, photographed, streamed live, edited, published, republished, or shared on Company platforms, social media, websites, or third-party channels at the Company's sole discretion, in perpetuity.

  • Company holds exclusive, worldwide, royalty-free rights to title, subtitle, thumbnail, edit, truncate, or sequence sessions for optimal publicity, engagement, or commercial purposes.

  • Company may use excerpts, clips, images, or derivatives in advertisements (Company's or third-party) without compensating Applicant, providing credits, royalties, or residuals.

  • Sessions may be live, pre-recorded, or hybrid; advertisements (Company's or third-party) may be inserted, overlaid, or appended without prior notice.

  • All revenue, proceeds, or benefits from sessions, views, sponsorships, ads, or derivatives are the Company's exclusive property; Applicant waives any claim thereto.

  • Applicant participates solely as a guest or participant; all content created (including Applicant's contributions) becomes Company property perpetually, with Applicant assigning all rights, title, and interest therein.

  • Company has sole discretion over editing, uploading, titling, promotion, deletion, archiving, storage, or withdrawal of content; no obligation to honor Applicant's requests, preferences, or demands.

  • Applicant must provide accurate photo, full name, brand logo (if applicable), Instagram handle, business name, and bio for promotional flyers, posters, or materials.

  • For online/virtual sessions, Applicant accepts secure conference links (HTTPS with 2FA protection) and agrees to join promptly.

  • Participation is entirely voluntary; Applicant must review flyer, schedule, and details before committing.

  • This contract activates immediately upon digital submission, remains perpetual, and covers all present, future, group, one-on-one, or related sessions (retroactive to August 1, 2022, for prior participations).

  • Applicant must conduct themselves respectfully, lawfully, and professionally; any unlawful, defamatory, harassing, or disruptive acts are Applicant's sole responsibility, with Company reserving termination rights.

  • Company may cancel, reschedule, or modify sessions without liability; this agreement persists unaffected.

 

Minor-Specific Terms (NDPA-Compliant)

 

If Applicant registers on behalf of a minor:

  • Applicant attests under penalty of perjury as the minor's parent/legal guardian with full authority; false claims incur personal liability.

  • All core terms bind both Applicant/guardian and minor.

  • Minor provides name, age, bio via secure WhatsApp (end-to-end encrypted); completes this form and adheres to contest rules.

  • Security: Company verifies guardian via encrypted government ID upload (AES-256 storage), 2FA authentication, and cross-check; no processing without confirmation. Minors have post-event withdrawal rights (prior footage exempt). No data shared with third parties without consent.

  • For educational programs and related promotional excerpts, where a minor is not the primary subject (including group debates or event coverage), the Company may fulfill any withdrawal or privacy request through reasonable de-identification measures—such as blurring visual features, removing names, or modifying audio—rather than removing the underlying content or promotional extract in its entirety.

 

Security, Data Protection, and Compliance

  • Data Protection (NDPA 2023): Personal data (names, photos, bios, IDs) processed only with explicit consent; encrypted (AES-256) in transit/storage; access logged with 2-year audit trail. Data breaches reported to Applicant and NITDA within 72 hours. Data minimized, retained only as necessary, with deletion rights upon request (subject to legal holds).

  • Platform Security: Registration via HTTPS/2FA; footage on tamper-proof servers with intrusion detection. No unauthorized access.

  • Dispute Resolution: Governed by Nigerian law; disputes via arbitration at Lagos Multi-Door Courthouse. Applicant confirms no duress; participation deemed beneficial.

  • Verification and Representations: Applicant warrants accuracy of all info, no IP infringements in contributions, and fitness for broadcast.

 

Acceptance and Binding Effect

 

By submitting this form, Applicant provides a legally binding digital signature (per Evidence Act 2011, Cybercrimes Act 2015), equivalent to wet-ink. This constitutes full, irrevocable acceptance of all terms. Policy subject to review; continued participation reaffirms consent. Last updated: December 2025.
